I think we have to post in MercadoLibre’s Facebook wall about this issue. Goin public (not just in this site) can help they do really something about this issue. Also all other social networks. What do you think?

I feel if I could verify their correct ISP I think this would be over. The have not answered that question 5 times now. I literally numbered them in my emails and had them as the first sentence on #4 and #5. “I am asking for the 4th time now, could you please verify your Internet Service Provider so I can verify I have sent the DMCA notice to the right company”. I get reply’s to most questions, never that one. I have sent three out now and only received one reply saying they do not host the the site MercadoLibre.com.
With a facebook thing they could easily delete it, they have deleted all of my comments on any product posting I have left comments on, and can’t seem to comment anymore. Maybe I have been banned.
It is really a bummer I have a new toy I want to share, and get some help with but this has taken most of my enthusiasm away.

Below is a limk to their corporate code of conduct and ethics. I’ve also pasted a link to their Board of Directors. I would suggest researching each of the members of their Board to find an email address. Then I’d send a personal very polite email to each of them laying out what has occuried and the issues that are not being resolved. I would tie this into their corporate code of conduct and ethics so that they take note of how the way this is being handled is contrary to their code.
I sit on a board of directors and if I received such an email I would definitely take note and start making inquiries.
Also according to their most recent SEC filing they are a U.S. corporation incorporated in Delaware in 1999. So, they cannot hide behind the “it’s in Argentina and the laws are different here” bulls#&t.

The mercadolibre.com subnet is part of the block assigned to Savvis, so I expect they’re co-located on Savvis servers in one or more of their datacenters.
Bill- I’ll send another DMCA to savvis, I am pretty sure I sent them one already.
David- I compiled a new list I will start the email now.

Savvis says they had hosted them at one point but not anymore, they were very helpful. They informed me it was MarkMonitor.com now hosting them.
After sending MarkMonitor the DMCA I received this reply 10 days ago.

I have sent a notice to the domains email, but I sent another for good measure. but to be informed that is was passed on by Markmonitor is interesting. I do believe I am due a response within 10 by law so maybe now a lawyer will be more willing to have a look at this. Who knows.
Not sure if this means anything but it looks like the domain is registered through Mark Monitor and only hosts their domain name DNS records. Century link is Savvis, I talked with them on the phone for a while today. They said they no longer have any affiliation with mercado libre. But who is to be trusted at this point they all say they have nothing to do with it.

Jeff - I have contacted to creative commons lawyers and have had no return call yet. I am hoping it is because of the holidays or maybe international stuff is to had to deal with. Ebay acts immediately, good or bad I think they instantly take down the reported post and then investigate. I had a posting or two taken down with a single email. I thought mercadolibre would be the same.
You may want to try contacting Ebay as tthey own at least 10% and probably more now of Mercadolibre. Not sure who you’d conract at Ebay but thought I’d mention it

I just got off the phone with a rep. His English was very limited. I was told I will get another call on Monday from someone that speaks English better, fair enough.
I sent him the same link and picture I have sent every single rep. He looked at it and immediately agreed I was the owner.
So what this does is now he signed me up for an account in every country they operate. So I have to sign in with this account, and “report” the posts. They will then review them within 48, give the owner of the post 7 days to respond and then we go from there. At that point I only have 2 days to respond and then they will remove it if the owner of the post agrees I am the owner. If they do not agree then what?
So as I see it any infringement has at least 9 days to sell their product before anything happens…every single time. This is bullshit. If they have a buy it now type program I will never be able to stop them in time.
I included the pdf of instructions.
I asked about the 20 something posts I already flagged and he said within 48 hours…even though it has been 16 days. My friends I am afraid this is another wild goose chase.
