Has anyone Looked at the above in relation to building and using the MPCNC. I am a self employed maker, and the machine will be used for making things I might sell. Like engraving indicator panels. Someone pointed out to me that the regulations above for the UK and EU cover even individuals that make and “Put into use” Machines for personal use. It seems looking at the scope of the regs that CNC machines and routers are covered by the regulations.
I have had a good trawl through the maker forums, but can’t see any reference to anyone taking the regs into consideration.
Thoughts?
Not a Lawyer, but those regulations apply slightly more to the manufacture and then supply of machinery, so if you wanted to build mpcnc’s and sell them you would have a pretty tall hurdle to jump, but the “put into use” part could likely be mostly be covered by recording and obtaining the Cert of Conformity for each part of the assembly, you avoid some of the electrical regs as its running on 12v.
I wouldn’t like to have to do it in court, but you could also argue that the 3d printed parts were made on a CE marked printer with CE marked PLA (which you would have record of) using the manufacturers instructions and therefore fit for purpose.
Should something go wrong and you get a visit from the HSE after building and using one as company, my guess would be that any investigation would probably focus more on “safety in the work place” regs.
So if you get all the paperwork together and keep it inside a CE marked enclosure, capable of protecting the user from flying debris, excessive noise and dust, interlocked to prevent opening while in operation, or at least cover the above to a standard you would expect to find in a workplace, you might just have done enough to cover your butt, .
Your biggest obstacle I’m betting is that no matter how hard you try, no one will tell you categorically that it is or isn’t ok, in the mental world of UK/EU health and safety I find there is very little help when dealing with grey areas, unless you pay someone a ton of money.
And if your lucky, after collating all the paperwork, you might actually be allowed to make something
In reality I think your very unlikely to get called out on it, just put as much effort in record keeping as you can, take the H&S side of thing seriously and if you don’t draw attention to yourself its not that likely that anyone will ever ask, I’m willing to bet a £1 that most inspections occur after neighbors call the council complaining about something.
Anyway, not much help, but that is my opinion on the matter and should be considered a work of fiction .
I don’t know but i know a man who probably will
